Selling or Gifting
Do not sell a ghost gun, or transfer ownership of a ghost gun, if money or any thing of value is exchanged in any way. If you do, you run the risk of being considered “in the business” of firearm manufacturing by the ATF. If this is the case, and you do not have a type 07 FFL, you may face severe criminal charges and fines. Be advised, if you are a type 07 FFL you are still required to serialize the firearm and follow all other rules required of you by law and the ATF.
Gifting is another story. If, as far as you are aware, a friend or family member can legally own firearms, and you give one to them free of charge, you are most likely in the clear under Federal law. Please be aware your state or city could have additional laws or regulations regarding gifting of firearms, and those laws or regulations might prohibit this practice. As always when it comes to legal matters, be careful and use good judgment. Don't be "that guy."
